Legal Rights And Obligations Of Private Schools

Blog

Private schools receive some space from the state and federal government to set some of their own standards. However, the government still regulates private schools in some ways. What exactly does a private school have the right to do and what requirements must they adhere to? Learn more about the legal rights and obligations of private schools.

Legal Right - Curriculum Selection

Public schools must adhere to a specific curriculum that provides a well-rounded education, and the children take standardized tests to assess their knowledge. Private schools have much more freedom regarding curriculum. Some private schools emphasize music and language arts without necessarily completing the state's math and science requirements or the other way around. Furthermore, private schools can choose how to test students and their graduation requirements. Despite the freedom to create the curriculum, private schools usually require more from the students than public schools.

Public schools are required by law to provide a curriculum for students with special needs. Private schools do not have the same requirement.

Legal Obligation - Health and Vaccinations

After the recent health pandemic, many states put health requirements in place at schools. Both public and private schools must adhere to state health laws, including vaccination. Some states do not require vaccination for students. Check your state laws for updated information.

Legal Right - Student Selection

Public schools must accept every child in the district by law until expulsion. Even then, public schools must have a program in place for expelled kids to still get an education. Private schools don't need to take all applicants. Some private schools gain a selective reputation this way. Class sizes stay small this way, too.

Legal Obligation - College Educated Teachers w/ Performance Reviews

While the rules vary from state to state, public teachers require state certification while private school teachers do not need the same certification. Private school teachers do need a college degree, and they need to pass a background check. They must also receive formal reviews every two years.

Legal Right - Religious Freedom

Public schools attempt to separate church and state in an effort to be inclusive of different faiths. Teachers can't teach religion in class. Christian private schooling has the freedom to teach religion. Private schools often have religious classes and church services. Private schools may also buy textbooks that teach through a religious lens, especially science and history.

Private schools come with a lot of benefits. However, it's best to manage your expectations. Hopefully, these rights and obligations helped to further your understanding of what to consider.
